Ethical Guidance Panel

Members of the legal profession who require guidance relating to ethical issues are encouraged to approach King’s/Senior Counsel or another senior member of the profession to discuss the matter in confidence.

King’s Counsel and Senior Counsel (silks) provide leadership to the profession in relation to ethical matters.  Most, if not all silks, are prepared to provide guidance on an informal basis and without charge to any member of the profession who needs assistance with an ethical question.

This page provides the names and contact details of silks who are members of the WA Bar Association and whose principal place of practice is in Western Australia.

Also appearing on this page are the names and contact details of other practitioners (Ethical Guidance Panel) who have indicated their willingness to be available to discuss ethical issues.

A practitioner seeking assistance should, at least in the first instance, contact a silk or a member of the Ethical Guidance Panel directly. Alternatively, if a difficulty in relation to availability or necessary expertise is encountered, a practitioner may telephone the WA Bar Association on (08) 9220 0477 for a referral to a silk, or may telephone the Society on (08) 9324 8600 for a referral to a member of the Ethical Guidance Panel with relevant expertise.

Practitioners seeking assistance should at the very start of any contact distinctly state that they are seeking assistance in relation to an ethical issue, and particularly when is necessary to reveal the names of clients, find out whether any conflict issues exist.

Guidance relating to ethical issues is usually given on an informal basis.  As a general rule, ethical guidance is that there is no lawyer/client relationship unless specifically agreed.
