Criminal Law (Mental Impairment) Act 2023 Seminar Three: Special Proceedings and Orders

The Law Society of Western Australia, in collaboration with the Department of Justice, has launched an education programme of seminars on the new Criminal Law (Mental Impairment) Act 2023.

The Criminal Law (Mental Impairment) Act 2023, repealed the Criminal Law (Mentally Impaired Accused) Act 1996 in its entirety and establishes a new scheme.

The third session will cover:

1. Special Proceedings

  • Experience from the Eastern States
  • How Special Proceedings will operate in WA, and
  • Ethical Considerations

 

2. ‘Orders Under the Act’

  • Limiting term proceedings and custody orders
  • Determination of appropriate order

  2. The Legal Practice Board of Western Australia states that CPD Points are awarded for a full hour and/ or half hour of attendance. Lesser periods are rounded down to the nearest half hour. 
  3. A practitioner cannot claim CPD points for attending a seminar that has the same content during the same CPD year. The content must extend the practitioner’s knowledge and skills in areas that are relevant to the solicitor’s practice needs or professional development.  Practitioners should not request CPD points for any subsequent seminars which contain the same or similar content within the same CPD year.
