Bitcoin has unique properties as a form of property – ‘a scarce digital property’.

The seminar will look at how bitcoin is treated in law currently and potentially in the future. Specifically, it will explore:.

1. Bitcoin as currency or legal tender in Australia – Seribu Pty Ltd v Commissioner of Taxation [2020] AATA 1840
2. Bitcoin is property in Australia – ATO, RBA, Digital Assets (Market Regulation) Bill 2023
3. UK case – AA v Persons Unknown & Ors, Re Bitcoin [2019] EWHC 3556 (Comm) (13 December 2019)
4. UK Law Commission paper – “Digital assets”: Final report HC 1486 Law Com No 412
5. NZ high court case – Ruscoe v Cryptopia Limited (in liq) [2020] NZHC 728
6. Advocacy by Australian Bitcoin Industry Body re Senate proposal on Digital Asset Framework.

Potential implications for practitioners and the legal fraternity in general will be discussed with a particular case study for Inheritance law.

  2. The Legal Practice Board of Western Australia states that CPD Points are awarded for a full hour and/ or half hour of attendance. Lesser periods are rounded down to the nearest half hour. 
  3. A practitioner cannot claim CPD points for attending a seminar that has the same content during the same CPD year.
