A Top Ten Hit List: Cases Which Establish the Rule of Law and Define Us

There are a number of cases which sit below the surface of our society and define the rule of law and who we are. For example, the decision of the US Supreme Court in Marbury v Madison explains why there can be judicial review of legislative action. Liversedge v Anderson deals with how executive action can be controlled by the courts through the writ of habeas corpus.

The purpose of this seminar is to examine some of those cases, and to remind participants of why various fundamental principles apply or should apply. Joshua Thomson will refer to other cases which establish the ability for judicial review of executive action, the reason why Parliament cannot direct the judicial process by reason of Ch III of the Constitution, how Australians ceased being British citizens, the recognition of native title and how the US Supreme Court first acknowledged and then rejected a constitutional right to abortions.
